JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 Earlier prayer for anticipatory bail of the petitioner was allowed conditionally by this Court vide order dated 19.9.2018 passed in Cr.Misc.No. 44605 of 2018 on payment of Rs.1,50,000/- by way of Bank Draft payable to the complainant and rest of the amount was directed to be deposited for a period of three months in equal instalment of Rs.1,50,000/- payable in the first week of each month.

However, learned counsel for the petitioner submits that petitioner could not surrender and he prays for extension of time for depositing the amount.

Heard learned APP also.

In the said circumstances, further four weeks time

Patna High Court Cr.Misc. No.73684 of 2018(2) dt.20-12-2018 2/2 from the receipt of this order is allowed to the petitioner to deposit Bank Draft of Rs.1,50,000/- payable in favour of the complainant and to deposit rest of the amount of Rs.4,50,000/- in three equal instalments in terms of the order dated 19.9.2018 passed in Cr.Misc.No. 44605 of 2018 and rest part of the order shall remain intact.

It is made clear that on failure to deposit any of the instalments, bail bond of the petitioner shall be liable to be cancelled and it is also made clear that no further time will be allowed.

With the above observation, this application is disposed of.
