JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Barun P.S. Case No. 147 of 2018 dated 23.07.2018 instituted for the offences under Sections 379, 411, 420, 34 of the Indian Penal Code, Section 4/40 of the Bihar Minor Mineral Concession Rules, 1972 and Section 15 of the Environment (Protection) Act, 1986. The petitioner is owner of the tractor over which illegally extracted sand was loaded. The name of the petitioner has transpired in the statement of the driver who was arrested with the vehicle.

The learned counsel for the petitioner has submitted that the vehicle in question was given to the driver

Patna High Court Cr.Misc. No.72789 of 2018(2) dt.21-12-2018 2/2 for being plied commercially with specific instructions that no law shall be breached. Going beyond the direction of the petitioner, his driver has loaded the illegally extracted sand. Regard being had to the aforesaid facts as also the clean antecedents of the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 147 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
