The petitioner is apprehending his arrest in connection with Madhubani Town P.S.Case No.138 of 2010 dated 8.5.2010 , registered for offences punishable under Sections 463, 485, 467, 468, 469, 471, 406, 420, 409, 120(B) of the Indian Penal Code.

Allegation as per FIR is that with respect to acquisition of the land of the informant they had received money but no compensation has been given with respect to acquisition of land and the same has been withdrawn by the petitioner. Submission of the learned counsel for the petitioner is that for the same a case has been lodged after four years and the matter relates to the payment of the compensation and for the

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Madhubani in connection with Madhubani Town P.S.Case No.138 of 2010 dated 8.5.2010, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
