JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Mohammadpur P.S. Case No. 132 of 2019 registered for the offences punishable under Sections 147, 148, 323, 379, 436 and 504 of the Indian Penal Code. As per FIR allegation against the petitioners is that they set the house of informant on fire and also taken away articles.

No.74198 of 2019(2) dt.21-11-2019 2/2 Submission of learned counsel for the petitioners is that there is inordinate delay of six days in lodging FIR which has not been explained and moreover there is land dispute between the parties and there is case and counter case between them.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Mohammadpur P.S. Case No. 132 of 2019, G.R.No. 2375 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
