JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 The petitioner apprehends his arrest in connection with Madanpur P.S.Case No. 213 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 . Allegation, as per the FIR is of recovery of 38.750 litres of English wine from Tata Indigo vehicle and two persons were arrested there and other two persons were succeeded in fleeing away. Petitioner is named in the FIR.

Submission of learned counsel for the petitioner is that petitioner has been made accused only on the basis of confession of co-accused, who has been arrested at the spot but nothing has been recovered from the possession of the petitioner and he has no criminal antecedent.
