This application for grant of anticipatory bail arises out of Keoti P.S. Case No. 149 of 2018, disclosing offence under Sections 379 of the Indian Penal Code and Sections 4/40 of Bihar Mining Act.

Keeping in mind the fact that the petitioner has criminal antecedent, as is evident from the statement made in paragraph 3 of the application, I am not inclined to grant him the privilege of anticipatory bail.

This application is dismissed.

The petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail

Patna High Court Cr.Misc. No.72943 of 2018(2) dt.18-12-2018 2/2 shall be considered on its own merit without being prejudiced by rejection of the present application for grant of anticipatory bail by this Court.
