Petitioner apprehends his arrest in connection with Salimpur P.S. Case No.128 of 2019 for the for the offence punishable under Section 30(a)(g),38 of Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case. Further submits that as per seizure list nothing has been recovered from conscious possession of the petitioner rather his name has surfaced on the confessional statement of co-accused. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on anticipatory bail in the

Patna High Court CR. MISC. No.72652 of 2019(2) dt.31-01-2020 2/2 event of his arrest or surrender in the Court below within a period of four weeks in connection with Salimpur P.S. Case No.128 of 2019 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna, subject to the conditions as laid down in section 438(2) of Criminal Procedure Code.
