The petitioner seeks bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code and Section 11 (1) (a) (d) of Prevention of Cruelty of Animals Act, 1960.

Petitioner along with some other accused persons are said to have been transporting seven cattles from Nepal to sell out in Lohagara Hat and he was apprehended along with cattles while other accused persons managed to escape. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in this case by police merely on

No.70585 of 2019(2) dt.04-12-2019 2/2 suspicion while he was passing through the place of occurrence at the time of occurrence and the real culprit managed to escape seeing the police party. Petitioner has no criminal antecedent and has been languishing in custody since 31.08.2019. Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Kishanganj in connection with Dighalbank P.S. Case No.69 of 2019.
