JUSTICE ARUN KUMAR ORAL ORDER 02-05-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody since 4.1.2018, seeks bail in Danapur PS Case No. 674 of 2017 registered under Sections 406 and 420/34 of the IPC.

The allegation in brief is that the informant booked a flat from the petitioner, a developer, and paid 95% amount of total consideration money amounting to Rs. 92,12,074/- by the year 2012 but thereafter even after persuasion made invariably the sale deed concerning the flat was not executed nor the money was returned back.

Learned Counsel for the petitioner submits that the informant failed to pay the remaining consideration amount therefore the flat was sold to some other person besides this there was no any written agreement, however the petitioner is ready to return back the admitted amount of Rs. 72,12,074/- to the informant in installments. Having considered the said facts and circumstances, the petitioner, namely, Praveen Kumar @ Praveen Singh is directed to

Patna High Court Cr.Misc. No.15179 of 2018 (6) dt.02-05-2018 be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Danapur in connection with Danapur PS Case No. 674 of 2017 with the condition that the petitioner will pay the admitted amount to the informant in three equal monthly installments and the first installment at the time of submission of bail bonds.
