2. The petitioner seeks regular bail in connection with Udwantnagar P.S. Case No. 472 of 2021 lodged on 31.10.2021, for the offence punishable under Sections 20(b)(ii)(c), 22, 25, 27(A) & 29 of the N.D.P.S Act read with section 26 of the Arms Act.

3. Learned Counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected twice vide orders dated 06.06.2023 & 03.05.2024 passed in Cr. Misc. Nos. 11008 of 2023 & 10968 of 2024 respectively. Counsel submits that petitioner is in custody since 31.10.2021.

4. Learned APP for the State opposes the prayer for bail of the petitioner and submits that commercial quantity of heroine has been recovered along with live cartridges in this case. Counsel submits that report has come from which it

Patna High Court CR. MISC. No.83419 of 2024(4) dt.09-05-2025 2/2 transpires that the case is pending for argument of defence and the Trial Court has indicated that if, both the prosecution and defence co-operates in smooth conclusion of the trial, then the same may be concluded within two months.

5. In this view of the matter, this Court is not inclined to grant regular bail to the petitioner. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.

6. Superintendent of Police, Bhojpur at Ara is hereby directed to produce all witnesses at the earliest in connection with Udwantnagar P.S. Case No. 472 of 2021 by directing the concerned S.H.O./I.O. of this case so that trial takes place at the earliest due to the reason that speedy trial is the constitutional vision of justice.

7. Registry is directed to transmit a copy of this order to the Superintendent of Police, Bhojpur at Ara through fax, e-mail or any other mode forthwith. Registry is further directed to hand over a copy of this order to Learned APP for the State who shall communicate this order to the Superintendent of Police, Bhojpur at Ara at his level.
