====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 04-08-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel appearing for the complainant.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 498 (A) of the Indian Penal Code.

3. The matter had earlier been referred to the Patna High Court Mediation Centre for resolution of disputes between the parties, but the mediation process failed. However, due to the efforts made by the counsels for both the parties, the parties have agreed to resolve their issues on the total payment of an amount of Rs. 4,50,000/- and some ornaments by the petitioner to the complainant which would be done within a period of three months. It is also submitted on behalf of the learned

Patna High Court CR. MISC. No.83867 of 2024(4) dt.04-08-2025 2/2 counsel appearing for the informant that during the stipulated period, the complainant would also take steps to withdraw the present case as well as the maintenance case.

On such agreement between the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on provisional bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Complaint Case No. 224 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/ 482 (2) of the BNSS, 2023.

5. However, both the parties would appear before the learned Court concerned after a period of two weeks on 18.08.2025 and the learned Court concerned would work out the modalities of agreement between the parties and then consider the confirmation of the provisional bail to the petitioner.
