None appeared on behalf of the State. Two petitioners, having clean antecedent , which fact has been stated in paragraph no. 3 of the petition and are in custody since 13.2.2018, have prayed for grant of bail in connection with Excise Case No. 38 of 2018 , registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for petitioners submits that on false accusation of recovery of huge quantity of Indian make foreign liquor from the car of petitioner no. 1, petitioner no. 1 and 2 who are owner and driver respectively, have been arrested.

Patna High Court Cr.Misc. No.15579 of 2018(4) dt.09-05-2018 2/2 Even though petitioners were arrested in the month of February , 2018 no adequate progress has taken place in the case.

Considering the nature of accusation, clean antecedent of petitioners and period of custody, let both the petitioners Ujjawal Singh and Sunil Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II - cum - Special Judge ( Excise ), Gopalganj / concerned court in connection with Excise Case No. 38 of 2018.
