Petitioners apprehend their arrest in Araria P.S. case no. 598 of 2016 instituted for the offence under Sections 379 and 411 of the Indian Penal Code.
It is alleged in the written report that the informant came to Civil Court on his brother's motorcycle and kept the motorcycle at southern side of main gate of the Court and when he returned back he found the motorcycle missing. The petitioners have mentioned in para 3 of the bail petition that petitioners have no criminal antecedents. But, in the case diary other criminal cases were found pending against the petitioners. Thereafter, supplementary affidavit has been filed stating
Patna High Court Cr.Misc. No.19142 of 2018(4) dt.08-05-2018 2/2 therein that petitioners are accused in four other cases. The learned Sessions Judge has mentioned in the impugned order that other accused persons have been facing trial but these petitioners are still absconding. Therefore, this Court is not inclined to grant anticipatory bail to the petitioners. Prayer for anticipatory bail of the petitioners stands rejected.
