2. The petitioners apprehend their arrest in a case registered for the offence under Sections 137(2), 96, 3(5) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
3. It is alleged that on 20.05.2025, all the petitioners kidnapped the minor daughter of the informant.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in this case. As a matter of fact, there was love-affairs between petitioner no. 1 and the victim (daughter of informant) and due to said love-affairs, the
Patna High Court CR. MISC. No.82139 of 2024(3) dt.27-01-2025 2/2 daughter of informant herself left her house on her own accord and solemnized marriage with petitioner no. 1. He further submits that petitioner nos. 2 to 5 are family members of petitioner no. 1. The victim, in her statement recorded under Section 180 of Bhartiya Nagrik Suraksha Sanhita, 2023, has denied the factum of kidnapping and has categorically stated that she has solemnized marriage with petitioner no. 1 and both of them are living together as husband and wife.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar, in connection with Kursela P.S. Case No. 124 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
