The petitioner seeks regular bail in connection with Mehsi P.S. Case No. 320 of 2017 for the offences punishable under Sections 395 of the Indian Penal Code.

The allegation is regarding certain miscreants having attacked the petrol pump of the informant and having snatched a sum of Rs.7500/- at pistol point as also having subsequently snatched a sum of Rs.76230/- from him, apart from taking away two mobile phones. The name of the petitioner appears to have cropped up upon confessional statement made by the co-accused person namely Raja Singh after he was apprehended by the police. The learned counsel for the petitioner submits that the petitioner is a non-FIR named accused person and he is

No.20114 of 2018 (4) dt.18-05-2018 2/2 innocent, however, his name has been dragged in the present case only on the basis of the confessional statement made by the coaccused person, namely, Raja Singh. It is submitted that the said Raja Singh has already been granted regular bail by this Court vide order dated 2.5.2018 passed in Cr. Misc. No. 19806 of 2018. It is the submission of the learned counsel for the petitioner that no TI Parade has taken place and the petitioner is languishing in custody since 31.10.2017.

Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VIth, Motihari in connection with Mehsi P.S. Case No. 320 of 2017.
