Petitioner, already in custody, seeks bail in connection with Bochahan PS Case No.79 of 2016, giving rise to Sessions Trial No.738 of 2016 registered under Sections 364, 365, 34 of the Indian Penal Code.
Allegation in brief is that the petitioner solemnized love marriage with the niece of the informant and after marriage used to torture her and it is alleged that the niece of the informant is traceless and probably she was killed by the accused persons.
Learned counsel for the petitioner submits that it was a love marriage and the wife of the petitioner herself left the house and went somewhere else, investigation has been
Patna High Court Cr.Misc. No.11519 of 2018(7) dt.19-06-2018 2/2 completed and no trace of her has been found out and the petitioner is in custody in this case for last two years as he is in custody since 18.06.2016 and the petitioner has no criminal antecedent.
Having considered the aforesaid facts and circumstances, petitioner Nantun Sahani is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 13th, Muzaffarpur in connection with Bochahan PS Case No.79 of 2016, giving rise to Sessions Trial No.738 of 2016 with following conditions:
(1) One of the bailors must be the close family member of the petitioner.
(2) The petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
