The petitioner, who is in custody since 25.08.2019, seeks bail in connection with Khagaria (Gangaour) P.S. Case No. 566 of 2019 dated 26.07.2019 instituted for the offences under Sections 341, 323, 324, 506, 307 and 34 of the Indian Penal Code.

The petitioner is alleged to have given a farsa blow on the head of the informant, leading to injuries in his parietal region. The injury report which has been brought on record indicates such injury has been opined to be grievous in nature.

Learned counsel for the petitioner has submitted that there is a counter version of the

Patna High Court CR. MISC. No.73617 of 2019(3) dt.06-03-2020 2/2 occurrence and in the aforesaid case, the petitioner has also been left injured. This fact does not find mention in the subject FIR in which the petitioner is seeking bail. It has also been submitted that the petitioner and the informant are agnates.

Considering the aforenoted aspects and taking into account that the petitioner has remained in custody since 25.08.2019, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Gangaour) P.S. Case No. 566 of 2019.

While granting bail to the petitioner, the court below shall insist upon an undertaking by him that he shall not tamper with the evidence and shall participate in the trial proceedings without fail.
