Petitioner is an accused in a case registered for offence under sections 302 and 120B IPC and 27 of the Arms Act. Learned counsel for the petitioner submits that the allegations do not inspire confidence as the occurrence has taken place at 1 AM in the house whereas the informant does not disclose the means of identification.

This Court finds that the informant has alleged that her husband was done to death under conspiracy hatched by her step mother-in-law along with her son Shyam Thakur and the instant petitioner as the friend of said Shyam Thakur. Informant has specifically named the petitioner in the FIR alleged that he fired at her husband when he was sleeping.

Patna High Court Cr.Misc. No.17293 of 2018 (3) dt.04-05-2018 Considering the gravity of the allegation, this Court is not inclined to grant bail to the petitioner for the present. The prayer for bail of the petitioner is rejected. (Madhuresh Prasad, J) Shashi.
