The petitioner has been in custody since 15.12.2017 in connection with Bibhutipur P.S. Case No. 300/2017 registered for the offences punishable under Sections 379 of the Indian Penal Code and later on Section 411 of the Indian Penal Code was added. Learned counsel for the petitioner submits that admittedly the motorcycle which was recovered, was not from his conscious possession rather it was kept in an open shed situated near the house of the petitioner which belongs jointly to himself and one Vikash Kumar.

Having considered the entire facts and circumstances and that the petitioner has got no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.18535 of 2018 (3) dt.26-04-2018 2/2 bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Rosera, Samastipur, in connection with Bibhutipur P.S. Case No. 300/2017.
