JUSTICE ARUN KUMAR ORAL ORDER 27-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 5.7.2017, seeks bail in Civil Lines PS Case No. 263 of 2017 (S.T. No. 2 of 2018) registered under Sections 363, 368, 379, 34 and 302 of the IPC. The allegation in brief is that Scorpio vehicle of the informant was taken away by his driver for personal work for going to Aurangabad but he did not return back, later on his dead body was found in Chenari and the Scorpio vehicle in accidental condition was also found in Chauparan Police Station of Hazaribagh.

Learned Counsel for the petitioner submits that the petitioner has been made accused merely on the basis of CDR details as he had called to the driver, they were acquainted because of living in the same locality, police has recorded his confessional statement but leading to the confessional statement no incriminating evidence has been collected against the petitioner, the petitioner has no criminal antecedent and has been in custody since 5.7.2017. Having considered the said facts and circumstances, the petitioner, namely, Vikash Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge IXth, Gaya in connection with Civil Lines PS Case No. 263 of 2017 (S.T. No. 2 of 2018).
