JUSTICE BIRENDRA KUMAR ORAL ORDER 24-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 147/148/149/302/307/427/ 120B of the Indian Penal Code.

About 100 male and female extremists allegedly attacked on the train and snatched arms of the informant and others as well as started firing at the police party causing death of some of the police personnel.

Learned counsel for the petitioner submits that petitioner is in custody since 07.08.2017. Some other co-accused who are not named in the FIR, were allowed bail by a coordinate Bench of this Court vide Annexure-2 with condition that they

Patna High Court Cr.Misc. No.10149 of 2018 (4) dt.24-04-2018 P2/ would be released after framing of the charges. The report of the learned trial Judge reveals that the charges have already been framed. However, the case is pending for prosecution evidence. Considering the general and omnibus nature of allegation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Chanan P.S. Case No.33 of 2013, with condition that both the bailors shall be resident of the territorial jurisdiction of the learned court-below and the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
