JUSTICE VIKASH JAIN ORAL JUDGMENT Date : 22-11-2019 As prayed, learned counsel for the petitioner is permitted to implead the Superintendent of Police, Patna as respondent no. 5, in course of the day.

2. The present writ petition has been filed "for a direction to the respondents concern for protection of life and personal liberty as guaranteed under Article 21 of the Constitution of India, as the respondent no. 4, i.e. Police of Kadam Kuan Police Station has regularly put her and her family members in agony and threat her to implicate them in criminal case otherwise vacate the dwelling house, therefore direction may be given to the respondent

Patna High Court CR. WJC No.1587 of 2019 dt.22-11-2019 2/2 no. 3 to take immediate act on the police who are regularly come at her residence and threat her to vacate the dwelling house."

Learned counsel for the petitioner submits that the petitioner is under the threat of forcibly being removed from her residential house at the hands of the police without however following any procedure known to law. It is submitted that several representations before various senior police officials have been filed but to no avail.

Having regard to the nature of the grievance of the petitioner, the writ petition is disposed of with a direction to the Superintendent of Police, Patna (respondent no. 5) to consider and dispose of the petitioner's representation (Annexure-5) said to have been filed before the Superintendent of Police, Patna, if pending, on its own merits in accordance with law expeditiously and to take further action in the matter if so considered necessary.

5. The writ petition stands disposed of with the aforesaid observations and directions.
