The petitioners seek regular bail in connection with Mufassil P.S. Case No. 258 of 2016 for the offences punishable under Sections 304(B) and 34 of the Indian Penal Code. The allegation in the present case is regarding the accused persons having done to death the victim girl on account of non fulfillment of demand of dowry.

At the outset learned counsel for the petitioners seeks to withdraw the present petition as far as the husband of the victim girl is concerned, who is the petitioner no.1 in the present case. The present petition as far as the petitioner no.1 is concerned, is dismissed as withdrawn.

As far as the petitioner no.2 is concerned, she is said

Patna High Court Cr.Misc. No.10819 of 2018 (4) dt.28-06-2018 2/2 to be the mother-in-law of the victim girl and it is submitted that no prejudice would be caused to the prosecution in case a lady is granted bail, specially in the facts and circumstances of the present case.

Per contra, the learned counsel for the informant has appeared and opposed the prayer for bail.

Having regard to the facts and circumstances of the case, the petitioner No.2, namely, Shemphul Devi, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Mufassil P.S. Case No. 258 of 2016.
