====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-07-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State.

Petitioner apprehends his arrest in connection with Bihar P.S. Case No. 266/17 registered for the offences punishable under Sections 341, 323, 324, 307, 504, 379, 34 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Petitioner is said to have given back portion of kudal causing injury on the right and back of the informant. The injury report of informant goes to show that the informant sustained two injuries, i.e., one lacerated wound 1/2" x 1/4" x deep on skull and one bruise 1" x 1/2" on right forearm. The Doctor has found the injury No. 2 simple in nature whereas injury No. 1

Patna High Court CR. MISC. No.69868 of 2019(3) dt.01-07-2020 2/2 was found grievous in nature.

According to prosecution in case itself, the author of injury No. 1 is co-accused Chhotelal.

Moreover, learned counsel for the petitioner submits that there is case and counter case between the parties and persons from the both the sides sustained injuries.

Considering the aforesaid circumstances as well as nature of allegation levelled against the petitioner, let the petitioner in the event of his arrest/surrender within six weeks from the date of receipt of this order to the Court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Bihar P.S. Case No. 266/17 subject to conditions as laid down under Section 438 (2) of the Cr.P.C. (Hemant Kumar Srivastava, J) GAURAV S./- U T
