JUSTICE SANJAY PRIYA ORAL ORDER 08-05-2018 Heard learned counsel for the petitioner and learned APP for the State as well as the counsel for the informant. Petitioner apprehends his arrest in Sohsarai P.S. case no. 214 of 2017 instituted for the offence under Section(s) 304B/34 of the Indian Penal Code.

Petitioner is husband of the deceased.

Learned counsel for the informant has submitted that in the instant case process under Sections 82 and 83 Cr. P.C. have already been issued against this petitioner.

In the written report there is allegation against this petitioner of committing physical and mental torture with the deceased for non fulfillment of demand of dowry. The process has also been issued against this petitioner. In such circumstances, this Court is not inclined to grant anticipatory

Patna High Court Cr.Misc. No.15839 of 2018(3) dt.08-05-2018 2/2 bail to the petitioner. Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the Court below and make prayer for regular bail which shall be considered and disposed of on its own merit in accordance with law without being prejudiced by the present order.
