Petitioner seeks bail in a case registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

One country made rifle is said to have been recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent. No incriminating article has been recovered from his conscious physical possession. He has been falsely implicated in the case at the instance of his enemies by planting aforesaid recovery from his possession. As no cartridge has been recovered from the possession of the petitioner,

Patna High Court Cr.Misc. No.19120 of 2018 (3) dt.18-05-2018 2/2 said rifle is of no use. He has no criminal antecedent. He has been languishing in custody since 14.11.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Kurtha P.S. Case No. 181 of 2017.
