The petitioners seek bail in a case registered under Section 392 of the Indian Penal Code. Later on, Section 411 of I.P.C. has been added.

Allegation is that four unknown miscreants on the point of fire arms snatched the bag of the informant containing Rs.41,500/-, owner book, ATM cards, credit card, identity card and official documents.

It has been submitted on behalf of the petitionerd that the petitioners are in custody since 29.08.2019 and have got no criminal antecedent. Charge sheet has been submitted in this

Patna High Court CR. MISC. No.70035 of 2019(2) dt.19-11-2019 2/2 case. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are not named in the F.I.R. Their name has come in this case on confessional statement of co-accused. There is no recovery of any incriminating article from the possession of the petitioners. The petitioners have not been put on T.I.P.

On behalf of the State, it is submitted that the petitioners are not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. case No.352 of 2019.
