Mr. Madan Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 04-12-2024 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in connection with Bakhri P.S. Case No. 177 of 2024, instituted under Sections 147, 149, 385, 504 and 506 of the Indian Penal Code.

3. As per the prosecution case, on the date of occurrence petitioners along with 8-10 unknown persons armed with weapons came at the field of the informant with intention to grab his land. The accused persons started dragging the informant on the point of pistol with intention to kill him but his uncle and cousin saved him

Patna High Court CR. MISC. No.80668 of 2024(2) dt.04-12-2024 2/2 and gave Rs. 4500/- to the accused persons. The accused persons demanded remaining extortion amount from the informant otherwise he will be killed and his land will be taken by the accused persons.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case due to land dispute. There is general and omnibus allegation against the petitioners. Petitioners have no criminal antecedents. They undertake to co-operate in the investigation.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bakhri P.S. Case No. 177 of 2024, subject to the conditions laid down in Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023. (Sunil Dutta Mishra, J) rakhi/- U T
