The petitioner is in custody since 22.01.2018 in connection with Harsidhi P.S. Case No. 19 of 2018 for the offence registered under Sections 489(B), 489(c)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is no material in the case diary to implicate the petitioner, save and except his confessional statement.

However, after perusal of the case diary and upon considering all the contents of the first information report and the material which has come forth, it appears that the petitioner had tried to transact by using the fake currency notes and had sought to take change of the said fake currency note of Rs. 2000/-. It was also discovered that the petitioner was having the said fake

Patna High Court Cr.Misc. No.18513 of 2018 (3) dt.27-04-2018 currency notes in his pocket also with the same number as that which was apprehended by the Nozzle Man.

In view of the aforesaid facts and circumstances of the case, I am not inclined to grant regular bail to the petitioner. It is, accordingly, rejected.

However, the petitioner will be at liberty to renew his prayer for after framing of charge.
