08-05-2018 Heard Sri Vivekanand Vivek, learned counsel for the petitioner and Sri Damodar Prasad Tiwary, learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 08-03-2018, having clean antecedent which fact has been stated in paragraph - 3 of the petition, has prayed for grant of bail in Ismailpur P.S. Case No. 06 of 2018 registered for offence under Sections 30A/38(1) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that in this case, from backside of house of the petitioner, 12 bottles of Beer containing each 650 ml. and 24 bottles of Royal Stag Whisky containing 375 ml. each were shown to be recovered. Since petitioner was owner of the house, from the
Patna High Court Cr.Misc. No.18196 of 2018(4) dt.08-05-2018 2/2 back of which recovery was effected, the petitioner has falsely been made accused in the present case.
Be that as it may, considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Ajay Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bhagalpur in connection with Ismailpur P.S. Case No. 06 of 2018.
