Petitioner, already in custody, seeks bail in connection with Patori PS Case No.54 of 2017, registered under Sections 364/34 of the Indian Penal Code. Later on Sections 302 and 201/34 of the Indian Penal Code were added.
Allegation in brief is that the daughter of the informant went to college and while returning back she was kidnapped by petitioner and two other unknown persons. Learned counsel for the petitioner submits that the informant is not the eye witness, there is no evidence in the case diary that the petitioner was ever seen with the daughter of the informant, merely on the basis of suspicion he has been made accused in this case and petitioner has no criminal antecedent
Patna High Court Cr.Misc. No.18595 of 2018(4) dt.16-05-2018 2/2 and the girl's body was found lying by side of railway track and postmortem report indicates her death caused by train and no sign of rape was found.
Learned counsel appearing on behalf of the informant opposes the prayer of bail and submits that mobile tower location of the petitioner was found at the place of occurrence. Having considered the aforesaid facts and circumstances, petitioner Ravi Raj @ Chhotu is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 2nd, Samastipur in connection with Patori PS Case No.54 of 2017, giving rise to Sessions Trial No.7 of 2018/4 of 2018.
