The petitioner seeks bail in connection with Kateya P.S. Case No. 209 of 2019, registered under Sections 120(b), 323, 341, 406, 420, 467, 468, 471, 504 and 34 of the Indian Penal Code.

The accusation is that office of the Munna Travels is situated at Ekderma Market, Gopalganj, which is engaged in providing the visa for going abroad in which the petitioner and three others were the officials.

While the complainant/informant, Virendra Kumar, by persuasion of the petitioner and other officials handed over Rs.94,900/- on different occasions for visa, but, neither visa was provided to him nor money was returned, in spite of several requests.

No.72677 of 2019(2) dt.11-12-2019 2/2 Submission is that while it is alleged that Rs.94,900/- was handed over by the complainant/informant to the petitioner and his associates, named in the complaint petition, but, no specific allegation has been made against the petitioner. Further, submission is that petitioner is in custody since 26.08.2019. The police, after informant, has already submitted the charge sheet.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Kateya P.S. Case No. 209 of 2019 to the satisfaction of the Additional Chief Judicial Magistrate, XV, Gopalganj.
