Petitioner, already in custody, seeks bail in connection with Birpur P.S. Case No.66 of 2017, giving rise to Sessions Trial No.101 of 2017, registered under Sections 304(B) and 120(B) of the Indian Penal Code.

Allegation in brief is that the petitioner's wife used to object the illicit relationship of the petitioner with his own aunt and it is further alleged that the petitioner and his family members tortured the deceased for realizing further dowry and the informant received information through the maternal uncle of the deceased that the deceased was admitted to Katihar Medical College and Hospital and found her in burnt condition.

No.21534 of 2018(6) dt.16-07-2018 2/2 Learned counsel for the petitioner submits that marriage was solemnized five years back, earlier there was no complain regarding asking further dowry and there are two children out of the wedlock, one daughter and one son; in fact the petitioner's wife sustained burn injuries as she caught fire while preparing meal and the petitioner tried to extinguish the fire and in that process also sustained burn injuries on his both hands and face and brought her wife to Katihar Medical College and Hospital for treatment wherefrom referred to Patna and brought her to Burn Hospital, Patna where she was declared dead and petitioner has been in custody for more than a year. Having considered the aforesaid facts and circumstances, petitioner Mukesh Jha is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd F.T.C., Supaul in connection with Birpur P.S. Case No.66 of 2017.
