2. The petitioner seeks regular bail in connection with Sheohar P.S. Case No. 252 of 2024 registered for the offence under Sections 25(1-b)(a), 26, 35 of the Arms Act.

3. The prosecution story is to the effect that the informant during the checking of the vehicles intercepted a motorcycle and apprehended two persons namely, Sanyog Kumar (petitioner) and one Pintu Kumar and recovered one country made pistol with two live cartridges from the petitioner and iron fighter (panja) was recovered from the other co-accused person.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and no such recovery which has been shown was made from the petitioner. He

Patna High Court CR. MISC. No.81899 of 2024(3) dt.17-04-2025 2/2 has further stated that the co-accused namely, Pintu Kumar who was apprehended along with the petitioner has been granted bail by a co-ordinate Bench of this Hon'ble Court by order dated 29.10.2024 passed in Cr. Misc. No. 76762 of 2024.

5. The learned APP opposes the prayer for bail and states that there is a recovery of two live cartridges and a country made pistol from the conscious possession of the petitioner and he does not deserve the liberty of bail.

6. Considering the fact that the petitioner is in jail since 03.09.2024 that is for more than eight months, let the petitioner be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S. Case No. 252 of 2024.
