The petitioner seeks regular bail in connection with Pipra P.S. Case No. 270 of 2017, for the offences punishable under Sections 363, 365, 302 of the Indian Penal Code. The allegation is regarding the husband of the informant having gone alongwith the petitioner and thereafter the husband of the petitioner did not return back and when the petitioner was asked about the whereabouts of the missing person, he did not give a satisfactory reply.
The learned counsel for the petitioner has submitted that no evidence or any concrete material has come in the case diary to connect the petitioner with the alleged offence apart from suspicion. It is further submitted that the postmortem report would
Patna High Court Cr.Misc. No.20215 of 2018 (3) dt.17-05-2018 2/2 show that the petitioner has died on account of falling in the well and getting drowned. The petitioner is languishing in jail since 27.10.2017 and has a clean antecedent.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East, Champaran, Motihari in connection with Pipra P.S. Case No. 270 of 2017.
