The petitioner seeks regular bail in connection with Janki Nagar PS case no. 131 of 2018 instituted for the offence punishable under Sections 302, 307 and other sections of Indian Penal Code.
The allegation is regarding the petitioner and other co-accused persons having arrived at the house of the informant and thereafter, they are said to have inquired about his brother namely Pappu Mukhia, whereafter they had telephonically called him to a nearby place and the accused person namely Shivam Rishideo had hit on the neck of the informant's brother.
The learned counsel for the petitioner has
Patna High Court CR. MISC. No.70504 of 2019(2) dt.04-12-2019 2/2 submitted that the petitioner is innocent and there is no allegation of him having assaulted the brother of the informant. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 10.05.2019. Lastly, it is submitted that exactly similarly situated co-accused person namely Pintu Rishideo has already been granted the privilege of regular bail by a co-ordinate Bench of this Court vide impugned order dated 08.05.2019 passed in Cr. Misc. no. 29138 of 2019.
Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Janki Nagar PS case no. 131 of 2018.
