The petitioner is languishing in custody since 31.03.2015 in connection with Kadirganj P.S. Case No. 100 of 2014 registered for the offence under Sections 302/34 of the IPC. The prosecution case, in brief, is that the informant's husband had gone out of his house to bring eggs then, the petitioner started abusing him and when the informant went there to pacify the matter, the accused persons, including the petitioner, started brutally assaulting her husband and the petitioner gave one Lathi blow on his head and thrown him in the well. Patna High Court Cr.Misc. No.8352 of 2018 (3) dt.18-05-2018 2/2 rejected on 17.08.2016 vide Cr. Misc. No. 13976 of 2016. A report was called for from the court below regarding the stage of the case. It has been reported by the court below that only Dr. and I.O. are to be examined on behalf of the prosecution and the trial is expected to be concluded within a period of three months.

Considering the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected in connection with S. Tr. No. 773 of 2015, arising out of Kadirganj P.S. Case No. 100/2014, pending in the court of learned 4th Additional Sessions Judge-cum-Special Judge, N.I.A. Patna.

The court below is directed to take all necessary steps to conclude the trial within a period of three months from the date of receipt/production of copy of this order.
