Petitioner, already in custody, seeks bail in connection with Amnaur P.S. Case No.74 of 2014 registered under Sections 341, 323, 342, 324, 307, 379, 328 and 120B of the Indian Penal Code. Later on Section 302 of the Indian Penal Code was also added.

Allegation in brief is that one Sanjay Singh caught hold the informant and brought to his house and it is alleged that he assaulted the informant alleging that he had entered inside the house for committing theft and it is also alleged that the petitioner gave knife blow on the neck of the informant as well as on his thighs and later on during treatment the informant succumbed to the injury.

No.16384 of 2018(7) dt.16-07-2018 2/2 Learned counsel for the petitioner submits that there is specific accusation against the petitioner of inflicting knife blow on the neck and thigh but the postmortem report clearly indicates that no knife injury like cut and piercing wound was found on the neck and thigh on the person of the informant rather the injury was caused by hard and blunt substance in the form of bruise and abrasions and the petitioner has been in custody for more than a year.

Having considered the aforesaid facts and circumstances, petitioner Awadhesh Singh @ Mama @ Munna @ Mana is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IX, Saran at Chhapra in connection with Amnaur P.S. Case No.74 of 2014.
