Petitioner, already in custody, seeks bail in connection with Barachatti P.S. Case No.410 of 2011 registered under Sections 147, 148, 149, 427, 452 and 120(B) of the Indian Penal Code as well as under Section 17 of the C.L.A. Act. Allegation in brief is that in the night large number of extremist group demolished the school by J.C.B machine. Learned counsel for the petitioner submits that except disclosure of the name of the petitioner as one of the members disclosed by a co-accused, there is no other material against him and he has been in custody for 11⁄2 years.

Having considered the aforesaid facts and circumstances, petitioner Bhim Yadav @ Pahariful @ Lulha @

Patna High Court Cr.Misc. No.22078 of 2018(3) dt.09-07-2018 2/2 Hari Mohan Ji is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sherghati, District Gaya in connection with Barachatti P.S. Case No.410 of 2011 with following conditions:

(1) One of the bailors must be the close family member of the petitioner.

(2) The petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
