ANJANA MISHRA ORAL ORDER 05-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 09.09.2019, in connection with Saraiya P.S. Case No. 258 of 2019 for the offenses under Sections 272, 273, 414, 34 of the Indian Penal Code and 30(a), 32(ii), 38(ii), 41(i) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were made from the truck and pick-up and not from the possession or from the house of the petitioner. The petitioner has no concern with the said liquor and vehicle. It is further submitted that the petitioner is accused in one more case in which he has already been granted bail.

Case No. 258 of 2019.
