The petitioners seek regular bail in connection with Ghanshyampur P.S. Case No. 178 of 2017, registered for the offence punishable under Sections 147, 148, 149, 323, 341, 302 and 34 of the Indian Penal Code.

The allegation is regarding the accused persons having assaulted the brother of the informant resulting in his death. The learned counsel for the petitioners submits that there is general and omnibus allegations of assault as far as the petitioners are concerned and in fact, they have been falsely implicated in the present case. It is further submitted that the petitioners are having a clean antecedent and the Petitioner No.

Patna High Court Cr.Misc. No.27045 of 2018(3) dt.09-07-2018 2/2 1 is languishing in custody since 09.01.2018 and the Petitioner No. 2 is languishing in custody since 26.11.2017. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail. Accordingly, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge2nd, Benipur, Darbhanga in connection with Ghanshyampur P.S. Case No. 178 of 2017.

It is further directed that the petitioners would mark their attendance before the Officer-in-Charge of the concerned police station at 10:00 am. on each Monday of the week and in the event of three consecutive defaults, the present privilege of the regular bail shall stand cancelled automatically.
