JUSTICE SANJAY KUMAR ORAL ORDER 29-06-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in connection with Dumaria Ghat P.S. Case No. 32 of 2018 registered for the offences punishable under sections 413, 414, 467 and 468/34 of the Indian Penal Code.

The informant of this case is S.H.O. of Dumaria Ghat Police Station. It is said that on the date of occurrence, the informant intercepted a vehicle which was being driving by this petitioner. On verification, the petitioner did not produce any paper relating to the said vehicle. The police further found that the registration number of the vehicle was altered suggesting that the vehicle was stolen one.

No.29571 of 2018 (3) dt.29-06-2018 2/2 It has been submitted that the petitioner is a driver of said vehicle belonging to his owner Hareshwar Singh and he was apprehended when he was returning after dropping the passengers. The petitioner has no concern with the said vehicle. He is in custody since 22.02.2018 having clean antecedent. The learned Additional Public Prosecutor on the other hand opposed the submission.

Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned court of Additional Chief Judicial Magistrate-I, in connection with Dumaria Ghat P.S. Case No. 32/2018, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
