The petitioner seeks regular bail in connection with Motihari Mufasil P.S. Case No.25 of 2021 registered for the offence punishable under Section 302/34 of the Indian Penal Code and under section 27 of the Arms Act. 3.

One Pappu Mukhiya is the assailant of the deceased. The petitioner is not the assailant of the deceased. He is alleged to have participated in the killing of the deceased. The petitioner is in custody since 08.08.2023. Pappu Mukhiya has been acquitted in a separate trial.

Learned counsel for the petitioner has produced the order dated 18.12.2024 passed in Criminal Miscellaneous No.80642 of 2024, by which the similarly

Patna High Court CR. MISC. No.85031 of 2024(2) dt.08-01-2025 2/2 situated co-accused namely, Shashi Bhushan Mukhiya @ Shashi Bhushan Kumar has been granted bail by this Court. 5.

Considering the aforesaid facts, this bail application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, X, East Champaran, Motihari, in connection with Motihari Muffasil P.S.
