JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Ballia P. S. Case No. 183 of 2019, registered for the offences punishable under Sections 498(A), 34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Petitioners are in-laws of the informant and it is admitted case of the informant that her marriage was solemnized on 19.05.2011 and after marriage, she had been leading peaceful married life at her matrimonial home for near

However, it is submitted on behalf of the petitioners that the husband of the informant filed divorce suit bearing Divorce Suit No. 23 of 2019 on 24.01.2019 and after that the informant brought the present case against her husband and in-laws. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioners, above named, in the event of their arrest/surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Ballia P. S. Case No. 183 of 2019, subject to conditions as laid down under Section 438(2) of the CrPC.
