JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-04-2018 Supplementary affidavit is filed on behalf of the petitioner. Let it be kept on record.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier, the petitioner was granted bail vide order dated 09.08.2012 passed in Cr. Misc. No.26245 of 2012 with direction to deposit the amount in question in Court within four months in four installments and it appears that in compliance of the aforesaid order, the petitioner deposited only 1,60000/- in the court concerned and after that she failed to deposit the remaining amount.

Learned counsel for the petitioner submits that the informant has filed Title suit against the petitioner and, therefore, it is obvious that the present dispute is of civil nature and

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-Xth, Gaya in connection with Bodh Gaya P.S. Case No. 12 of 2012/ Trial No. 175 of 2017.
