JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-12-2019 The petitioner, who is in custody since 04.09.2019 seeks bail in connection with Complaint Case No. 101C3 of 2019 which has been registered for investigation under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

A total of 183 litres of liquor is said to have been recovered from the house of the petitioner. Learned counsel for the petitioner submits that petitioner is a house lady and she has been falsely implicated in this case because the leader of the raiding team was demanding money from her. The house from where the recovery is said to have been made is

No.71648 of 2019(2) dt.04-12-2019 2/2 occupied by other members of the family as well and therefore the petitioner cannot solely be saddled with the responsibility of having stored the liquor in this house. Considering the fact that the accusation against the petitioner is only on the basis of suspicion, the petitioner, above named, is directed to be released on bail on her furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Khagaria in connection with Complaint Case No. 101C3 of 2019.
