Petitioner apprehends his arrest in connection with Cheriyabariyarpur P.S. Case No.45 of 2019 for the offence punishable under Sections 341, 323, 354B, 436/34 of the IPC. Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case. The present First Information Report has been lodged after ten days of the alleged occurrence without there being any explanation for the delay. As a matter of fact, the police after investigation has submitted charge-sheet under bailable sections only. The cognizance has been taken under section 436 I.P.C., however from perusal of the allegations levelled in the First Information
Patna High Court CR. MISC. No.74583 of 2019(2) dt.05-02-2020 2/2 Report no case under section 436 I.P.C. is made out against this petitioner. Petitioner is a man of clean antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on anticipatory bail in the event of his arrest or surrender in the Court below within a period of four weeks in connection with Cheriyabariyarpur P.S. Case No.45 of 2019 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Manjhaul (Begusarai), subject to the conditions as laid down in section 438(2) of Criminal Procedure Code.
