2. The petitioner is in judicial custody in connection with S.T. No. 164 of 2021 arising out of Musarigharari P.S. Case No. 84 of 2020 for the offence punishable under Sections 302, 307, 326, 341, 120(B)/34 of the Indian Penal Code and 27 of the Arms Act lodged on 12.8.2020 by the informant, Maheshwar Ray.

3. Earlier report was called for which has been received. According to which, out of 12 witnesses, 11 have already been examined.

4. Considering the fact that the trial is at its fag end, for the present this Court is not inclined to extend the privilege

However, in view of the fact that he is in custody since 13.8.2020, the trial Court will ensure that the trial is concluded within a period of six months by taking it up on day-to-day basis failing which a report shall be submitted for the reason in delay of the trial.

5. The petitioner has brought on record certain document to show that he needs immediate treatment at Indira Gandhi Institute of Medical Sciences, Patna. An appropriate petition will be filed before the learned trial Court who shall ensure that all the necessary medical assistance is rendered to the petitioner on the petition so filed and an order shall be passed on the said petition at an earliest.
