JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 20-02-2026 Heard learned counsel appearing on behalf of the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.

2. The accused/petitioner apprehending his arrest in connection with Cyber P.S. Case No. 35 of 2025 registered for the offences punishable under Sections 66(E), 67 and 67(B) of the Information Technology Act, 2000.

3. As per FIR, petitioner alleged to developed friendship on Instagram with daughter of the informant (age not mentioned) and, thereafter, the objectionable video of daughter of the informant was made viral.

4. It is submitted by learned counsel appearing on behalf of the petitioner that there is no allegation of sexual

It is submitted that all eight mobile numbers mentioned in FIR, none are connected in any manners with petitioner and merely on the basis of suspicion against this petitioner, who is a man of clean antecedent alleged to operate a gang and doing flirts with innocent girls after taking them in confidence, the present FIR was lodged. It is submitted that even the allegation of blackmailing is also raised as suspicion.

5. Learned APP, duly assisted by learned counsel Mr. Shekhar Kumar Singh, appearing on behalf of the informant, while opposing the prayer of bail submitted that the allegation is specifically against petitioner.

In view of aforesaid factual submissions and by taking note of fact as allegation qua sexual assault is not available against petitioner, where none of the mobile numbers prima facie appears connected with this petitioner, coupled with the fact that the allegation of blackmailing is also appears raised on the basis of suspicion against petitioner, accordingly, above named petitioner, in the event of his arrest or surrender before the learned trial Court, within a period of four weeks of the order, is directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate,
