Petitioner, already in custody, seeks bail in connection with Gaurichak PS Case No.65 of 2017, registered under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code as well as under Section 27 of the Arms Act. Allegation in brief is that the petitioner and others on account of dispute with Dilip Paswan, opened fire as a result the son of the informant and others standing near got injured and the petitioner was apprehended by the local people and thrashed and police after reaching there brought the petitioner and other injured to hospital for treatment.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.13388 of 2018(3) dt.25-04-2018 2/2 allegation against the petitioner is falsified from the fact that he was not apprehended at the spot. The allegation is dated 13.03.2017 and the petitioner was taken into custody on 08.12.2017 and he was never brought to any hospital for treatment.
Having considered the aforesaid facts and circumstances, petitioner Jai Mal Paswan @ Jai Mangal Paswan @ Jai Mala Paswan is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VII, Patna City in connection with Gaurichak PS Case No.65 of 2017.
